District 42 special election

Citizens Alliance of North Dakota stands firmly for the principles of liberty, accountability, and ethical governance in our state.

We are deeply troubled by the recent revelation that Dustin McNally, appointed to the House of Representatives for District 42, used his official University of North Dakota email address to conduct political campaigning.

This action is a direct violation of NDCC § 16.1-10-02, which forbids the use of state property or services for political purposes. Such misuse is defined as a Class A misdemeanor under NDCC § 16.1-10-08.

North Dakota law is unequivocal: public resources must serve the public, not personal ambitions.

McNally’s email, sent from [email protected], promoted his candidacy and asked for voter support, crossing a clear legal line. Under NDCC § 16.1-10-07, guilty parties must forfeit their nomination or election.

As a state university employee, this conduct erodes public trust in both higher education and public service. That’s why we are calling for his immediate resignation and urging the North Dakota Ethics Commission to launch a full investigation.

Residents of Grand Forks deserve a Representative chosen by voters — not appointed after scandal. Right now, District 42 is represented by an interim legislator who violated state ethics law by using taxpayer resources for campaigning.
